These Terms & Conditions govern your use of the Takeaway Scout website and associated local Takeaway Scout websites and services (“the Website”).

By accessing or using the Website, you agree to these Terms.

Nothing in these Terms affects your statutory rights.

Takeaway Scout is an online takeaway discovery, information and ranking platform operated by Brecon Take Aways Limited.

Our aim is to help users discover and compare takeaway businesses throughout the United Kingdom.

The Website may include:

Takeaway Scout does not prepare or sell food merely because a takeaway appears on the Website.

Unless expressly stated otherwise, food orders are placed with and supplied by the relevant independent takeaway business or third-party ordering provider.

2Local Takeaway Scout Websites and Domains

Takeaway Scout may operate through TakeawayScout.co.uk and through local or regional websites and domain names operated as part of the Takeaway Scout network.

These may include websites dedicated to individual towns, cities or geographic areas.

Such websites may display information drawn from or connected with the wider Takeaway Scout platform.

Unless expressly stated otherwise, these websites and services are operated by Brecon Take Aways Limited as part of the Takeaway Scout network.

References in these Terms to the “Website” include such Takeaway Scout-operated local websites where applicable.

3Takeaway Listings

Takeaway Scout may list takeaway businesses using information obtained from businesses themselves, publicly available sources, users and other lawful sources.

A takeaway does not necessarily have a commercial relationship with Takeaway Scout merely because it appears on the Website.

Takeaways may therefore appear on Takeaway Scout without being paying customers, advertisers or participating businesses.

We may provide businesses with facilities to claim, verify, correct or enhance their listings.

Where appropriate, businesses may contact us if they believe factual information displayed about their business is inaccurate.

4Takeaway Scout Scores and Rankings

Takeaway Scout may produce proprietary ratings, scores, rankings or other assessments, including the Takeaway Scout Score or Scout Score.

Scores and rankings represent an assessment produced using the methodology, information and criteria adopted by Takeaway Scout at the relevant time.

They should not be interpreted as guarantees of food quality, customer experience or future performance.

Takeaway Scout may update its methodology, criteria, weighting, information sources and scoring systems from time to time.

Changes to underlying information or methodology may result in a business's score or ranking increasing or decreasing.

Paid services do not purchase a higher Scout Score

Purchasing advertising, an enhanced listing, a subscription, promotional services or another paid product does not entitle a business to a higher Scout Score or favourable alteration of its independent ranking.

Where businesses pay for enhanced visibility, advertising, sponsorship or promotional placement, we may identify that content using appropriate descriptions such as “Sponsored”, “Featured”, “Promoted” or similar wording where required.

Commercial relationships and independent Scout Scores are intended to remain separate.

5Reviews and User Contributions

Where Takeaway Scout allows users to submit reviews, ratings, photographs, comments or other material, users must provide content honestly and responsibly.

You must not submit content that:

Businesses, owners, employees and persons acting on their behalf must not submit reviews pretending to be independent customers.

Businesses must not arrange or encourage fake positive reviews about themselves or fake negative reviews concerning competitors.

Takeaway Scout may investigate, moderate, reject, restrict or remove user-generated content where we reasonably believe it breaches these Terms, applicable law or our review policies.

6Review Authenticity and Moderation

Takeaway Scout may use reasonable measures designed to identify suspicious, fraudulent, incentivised or manipulated reviews.

However, we cannot guarantee that every review represents a genuine customer experience or that every false or misleading review will be identified immediately.

The opinions expressed in user reviews belong to the relevant contributors and do not necessarily represent the views of Takeaway Scout or Brecon Take Aways Limited.

Where appropriate, businesses may report reviews that they reasonably believe breach our policies.

The fact that a business disagrees with a review or considers it unfair does not, by itself, require us to remove it.

7Business Profiles and Claimed Listings

Takeaway businesses may be given the opportunity to claim or manage their business profile.

We may require reasonable verification before giving a person control of a business listing.

A person claiming or managing a listing confirms that they are authorised to act for the relevant business.

Businesses are responsible for information they provide to Takeaway Scout and should take reasonable steps to keep that information accurate and current.

Claiming a listing does not give the business ownership of the Takeaway Scout Website, Scout Score, ranking methodology or other Takeaway Scout intellectual property.

8Free and Paid Business Services

Takeaway Scout may offer both free and paid services to takeaway businesses.

Paid services may include:

The price, duration and specific features of a paid product will be displayed or otherwise agreed when it is purchased.

Unless expressly stated otherwise, purchasing a paid service does not guarantee increased enquiries, orders, website traffic, revenue, ranking position or commercial performance.

Separate commercial terms may apply to particular subscription, advertising or business products.

9Advertising and Sponsored Content

Takeaway Scout may display advertising, sponsored content and paid promotional placements.

Where required, paid promotional content will be distinguished from independent editorial content or rankings.

Payment for advertising or promotional visibility does not give an advertiser control over Takeaway Scout's independent scoring methodology or automatically improve its Scout Score.

Takeaway Scout may determine the location, presentation and availability of advertising and promotional products subject to any separate agreement with the advertiser.

10Information Accuracy

We take reasonable steps to provide useful and accurate information.

However, takeaway information can change frequently.

This includes:

Some information may originate from the takeaway itself or from other sources outside our direct control.

Users should confirm important or time-sensitive information directly with the takeaway before ordering.

If we become aware of materially inaccurate information, we may correct or remove it where appropriate.

11Food Orders

Unless expressly stated otherwise, Takeaway Scout does not sell takeaway food.

Where the Website links to a takeaway's website, telephone number, ordering platform or another third-party service, any food order is made with the relevant business or service provider.

The relevant takeaway is responsible for matters including:

12Delivery Services

A takeaway listing may contain information concerning delivery options.

Takeaway Scout itself does not become the delivery provider merely because delivery information or a delivery link appears on a listing.

In some locations, delivery services may be provided by Brecon Take Aways Limited, through Countryside Eats™, by an authorised Countryside Eats operator, by the takeaway itself or by another independent provider.

Where a separate delivery service is booked, the terms applicable to that service will govern the delivery.

13Links to Third-Party Websites

Takeaway Scout may contain links to takeaway websites, ordering platforms, social-media pages, delivery providers and other third-party websites.

Unless expressly stated otherwise, those websites are independently operated.

We do not control their content, availability, privacy practices or terms.

Users should review the terms and privacy information of third-party services before using them or entering into a transaction.

14Intellectual Property

Takeaway Scout and its associated intellectual property are owned by or licensed to Brecon Take Aways Limited.

This may include:

Nothing in these Terms transfers ownership of Takeaway Scout intellectual property to users or listed businesses.

You may not copy, reproduce, scrape, systematically extract, republish, distribute or commercially exploit protected Takeaway Scout content or databases without permission except where permitted by law.

Takeaway businesses remain responsible for and retain such rights as they may have in content they provide to us, subject to the permissions necessary for Takeaway Scout to display and use that content in connection with the service.

15Automated Access, Scraping and Data Extraction

You must not use automated systems, bots, crawlers, scraping tools or similar technology to systematically extract Takeaway Scout listings, scores, reviews, databases or other protected content without our prior permission, except where such activity cannot lawfully be restricted.

You must not use extracted Takeaway Scout data to create or populate a competing directory, ranking service or commercial database in breach of our intellectual-property or database rights.

16Use of the Website

You may use Takeaway Scout for lawful purposes.

You must not:

17Changes to Scores, Rankings and Listings

Takeaway Scout may update listings, scores and rankings as information changes.

A business's position may therefore change without notice as a result of:

Businesses cannot require Takeaway Scout to alter an independent score merely because they disagree with the result.

This does not prevent a business from bringing genuine factual inaccuracies to our attention.

18Removal and Correction of Business Information

Takeaway Scout aims to provide a useful and comprehensive takeaway directory.

The fact that a business does not wish to participate commercially with Takeaway Scout does not necessarily mean that all factual references to that business must be removed.

However, businesses may contact us concerning inaccurate information, misuse of intellectual property, personal information or another legitimate concern regarding a listing.

We will consider such requests in accordance with applicable law and our policies.

19Website Availability

We aim to maintain the availability and functionality of Takeaway Scout but cannot guarantee uninterrupted access.

The Website may occasionally be unavailable because of maintenance, technical problems, security issues, telecommunications failures or circumstances outside our reasonable control.

We may modify, add, remove or discontinue features where reasonably necessary.

20Liability

Nothing in these Terms excludes or restricts liability where doing so would be unlawful.

We are responsible for losses that are a foreseeable consequence of our breach of these Terms or failure to exercise reasonable care and skill where we have a legal responsibility to do so.

Takeaway Scout provides information intended to assist users in discovering and comparing takeaway businesses. Scores, rankings, reviews and other information should not be treated as guarantees of a particular experience.

We are not responsible for the independent acts or omissions of takeaway restaurants, delivery providers or other third parties where those matters fall outside our responsibility.

Nothing in this section affects statutory rights that cannot lawfully be excluded.

21Privacy and Data Protection

Brecon Take Aways Limited processes personal information in accordance with applicable UK data-protection law.

Where a business has purchased a subscription or other paid service, any specific contractual provisions concerning changes to that service will also apply.

24Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer, nothing in these Terms removes any mandatory rights concerning the jurisdiction in which proceedings may be brought.

23Domain Name Sales, Leases and Commercial Enquiries

Brecon Take Aways Limited may separately offer certain domain names for sale, lease or licence, either individually, in groups or as a portfolio. Any availability statement, portfolio page, domain page, advertisement, valuation, price indication, invitation to enquire or discussion is an invitation to negotiate only and does not itself create a sale, lease, reservation, option, exclusivity arrangement or other binding right.

A binding domain transaction exists only when the parties enter into the applicable written Domain Name Sale & Assignment Agreement or Domain Name Lease & Licence Agreement (or another written agreement expressly approved by Brecon Take Aways Limited) and any stated conditions for formation or completion are satisfied.

Unless a signed domain agreement expressly states otherwise, a domain transaction does not include or transfer the Takeaway Scout™ brand, trade marks, Scout Score methodology, rankings, reviews, databases, personal data, merchant data, software, source code, website content, social-media accounts, email accounts, telephone numbers, goodwill, business contracts or any other asset of Brecon Take Aways Limited.

Domain availability and completion are subject to the rules, procedures and technical requirements of the applicable registry and registrar. A domain sale is not complete merely because money has been discussed, invoiced or paid if the applicable written agreement makes completion conditional on a registrant transfer or other completion step.

Domain leases and licences do not transfer ownership of the domain unless a separate written sale or transfer agreement expressly provides otherwise. The specific domain agreement prevails over these Website Terms to the extent of any inconsistency concerning that transaction.
